PolicyPocket Privacy Policy

PolicyPocket is a digital insurance platform operated by PolicyPocket Insurance Agency LLC, a New Jersey licensed insurance producer (NPN 22289386), which provides all insurance quoting, placement, and servicing. The website, mobile application, and underlying technology platform are owned and operated by PolicyPocket LLC, a Delaware limited liability company, which is responsible for the technology and data infrastructure. These affiliated entities are referred to together in this Privacy Policy as "PolicyPocket," "we," "us," or "our." This Privacy Policy describes how we collect, use, share, and protect your information when you use our website, mobile application, AI assistant, and related services (the "Services"). Both entities may act as joint controllers of your information for the purposes described here.

By using the Services, you agree to the practices described in this Privacy Policy.

Information you provide to us:

• Contact and identity information: name, phone number, email address, date of birth, home address, and living situation.
• Insurance application information: driver's license numbers, vehicle information (including VINs), household and driver details, driving history, property details (such as home characteristics, pools, dogs, or trampolines), current and prior insurance information, and coverage preferences.
• Payment information: bank account details (connected through Plaid) or payment card information (held by a secure payment provider). Full payment card numbers are stored by that provider, not on our systems. To process a payment, an authorized licensed agent can view your full payment details for a short time and passes them to your insurance carrier, which charges the premium. If you connect a bank account through Plaid, your information is also subject to Plaid's End User Privacy Policy.
• Communications: messages you exchange with our AI assistant and our licensed agents, emails, text messages, and phone calls, which may be recorded and retained for quality, training, compliance, and record-keeping purposes.

Information we collect from third parties

To simplify quoting and reduce the information you have to type, we obtain data about you from third-party sources with your knowledge or consent, including:

• Identity verification services (such as Prove), which help us verify your phone number, address, and date of birth.
• Insurance data services (such as Canopy Connect), which, with your authorization, retrieve your current or prior insurance policy details, including vehicles, drivers, and license information.
• Property and risk data providers (such as Fenris), which supply vehicle, household, and property information used to pre-fill your application.
• Consumer reporting agencies and insurance-support organizations, which may provide driving records, claims history (such as CLUE reports), credit-based insurance scores, and similar reports where permitted by law. These are used by us and by insurance carriers to quote and underwrite your policy.
• Insurance carriers, which provide policy, billing, and claims information for policies we service.
• Referral partners, such as auto dealerships, which may provide your contact information when you request an insurance quote through them. If you were referred by a dealership, we may confirm to that dealership whether you requested a quote or purchased a policy; we do not share your detailed application information with them.

Information collected automatically

When you use the Services, we automatically collect device and usage information such as IP address, device type, browser type, operating system, pages viewed, and interactions with the Services, using cookies and similar technologies. See Cookies and Analytics below.

We use your information to:

• Provide insurance quotes from multiple carriers and help you compare options
• Submit applications to insurance carriers, bind coverage, and issue policy documents and ID cards
• Service your policies, including billing, renewals, endorsements, cancellations, and claims assistance
• Verify your identity and prevent fraud
• Operate and improve our AI assistant and the Services, including quality assurance and training of our systems and personnel
• Communicate with you about your quotes, policies, and account, including by phone, email, and text message
• With your consent where required, send you marketing communications, including renewal and win-back offers
• Comply with insurance regulations, licensing requirements, and other legal obligations
• Protect our rights, our customers, and the security of the Services.

PolicyPocket uses an AI assistant ("Andy") to guide you through quoting and policy service. When you chat with Andy, you are interacting with an automated system supervised by licensed insurance agents. Your conversations are recorded and may be reviewed by our agents and used to service your account, ensure accuracy and compliance, and improve our systems. Licensed agents are available during business hours, currently 8 AM to 8 PM Eastern, Monday to Saturday, and licensed agents handle the binding of coverage. Outside those hours, you can still get quotes with Andy, and your coverage is bound once a licensed agent is available. Do not rely on the AI assistant for legal advice; coverage is governed by the terms of the policy issued by your insurance carrier.

We share your information with:

• Insurance carriers and their representatives, to obtain quotes, bind and issue policies, process your premium payments (including your payment details), and service your coverage and claims
• Lienholders, lenders, mortgage companies and brokers, landlords, and condominium associations that need evidence of insurance, such as a binder or proof of insurance for your policy
• Comparative rating and agency management platforms (such as EZLynx) used to generate quotes and manage your policy records
• Service providers that perform functions on our behalf, such as identity verification, data retrieval, payment processing, cloud hosting, data storage, analytics, communications, and AI infrastructure. These providers are permitted to use your information only to perform services for us
• Consumer reporting agencies and insurance-support organizations, as permitted by law, in connection with quoting, underwriting, and fraud prevention
• Professional advisors and regulators, including auditors, attorneys, and state insurance departments, where required
• Law enforcement or other parties when required by law, subpoena, or legal process, or to protect rights, safety, or property
• Successors in interest, in connection with a merger, acquisition, financing, or sale of all or part of our business.

We do not sell your personal information. We do not share your nonpublic personal information with nonaffiliated third parties for their own marketing purposes.

As an insurance agency, PolicyPocket is a financial institution subject to the Gramm-Leach-Bliley Act. We collect nonpublic personal information about you from the sources described under Information We Collect. We disclose that information only as described under How We Share Your Information — that is, as necessary to provide our services to you, as permitted by law, or with your consent. We restrict access to your nonpublic personal information to personnel and service providers who need it to provide products and services to you, and we maintain physical, electronic, and procedural safeguards designed to protect it. Because we only share your information as permitted by law, no opt-out is required; if that ever changes, we will notify you and provide an opportunity to opt out.

This section serves as our notice of information practices under the New Jersey Insurance Information Practices Act (N.J.S.A. 17:23A-1 et seq.):

• Collection from other sources. Personal information may be collected from persons other than the individual(s) proposed for coverage.
• Types of information and sources. The types of information collected and the sources we use are described under Information We Collect, and may include information from identity verification services, your current or prior insurance carriers, consumer reporting agencies, and insurance-support organizations. Investigative techniques may include obtaining motor vehicle records, claims-history reports, and credit-based insurance scores.
• Disclosure without authorization. In certain circumstances, this information, and other personal or privileged information subsequently collected, may be disclosed to third parties without your authorization, as permitted by N.J.S.A. 17:23A-13 — for example, to insurance carriers to quote and underwrite your coverage, to persons servicing your policy or claims, to detect or prevent fraud, or as required by law.
• Access and correction. You have a right of access to recorded personal information we hold about you and a right to request correction, amendment, or deletion of it, as provided in N.J.S.A. 17:23A-8 and 17:23A-9. To exercise these rights, contact us using the details under Contact Us, and we will respond within the timeframes required by law.
• Insurance-support organizations. Information obtained from a report prepared by an insurance-support organization may be retained by that organization and disclosed to other persons.
• Adverse underwriting decisions. If an adverse underwriting decision is made, you have the right to receive the specific reasons for the decision and the sources of the information on which it was based, upon request.

By providing your phone number and requesting a quote, you consent to receive calls and text messages from PolicyPocket related to your quotes, policies, and account, including messages sent using automated technology. Message and data rates may apply. Message frequency varies. You can opt out of text messages at any time by replying STOP, and get help by replying HELP. Consent to marketing messages is not a condition of purchasing any insurance product, and you may opt out of marketing communications while continuing to receive transactional messages about your policies.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with any third parties, except with service providers acting on our behalf solely to deliver messages to you.

We use cookies and similar technologies to keep you signed in, remember your preferences, measure how the Services are used, and improve performance. You can control cookies through your browser settings, though disabling them may limit some features.

We do not currently sell personal data or use it for targeted advertising as defined by state privacy laws, and we treat browser-based universal opt-out signals (such as Global Privacy Control) accordingly. Because there is no common industry standard, we do not otherwise respond to "Do Not Track" browser signals.

We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit, access controls, and secure cloud infrastructure. No system is completely secure, however, and we cannot guarantee absolute security.

We retain your information for as long as needed to provide the Services and as required by insurance record-keeping laws and other legal obligations, which generally require retention of policy and transaction records for several years after a policy ends. Quote information for policies that are not purchased is retained for a limited period for compliance, follow-up, and record-keeping purposes.

• Marketing opt-out: You may opt out of marketing emails via the unsubscribe link and marketing texts by replying STOP.
• Access and correction: You may review and update your account information in the app, or contact us to request access to or correction of your information.
• New Jersey insurance rights: You have access and correction rights over recorded personal information under the NJ Insurance Information Practices Act, as described under New Jersey Notice of Insurance Information Practices.
• New Jersey Data Privacy Act: As a financial institution subject to GLBA and an insurance producer, we believe we are exempt from the New Jersey Data Privacy Act. We nonetheless honor reasonable requests to confirm, access, correct, or delete personal data where not inconsistent with our legal obligations. • Residents of other states may have similar rights under their state's privacy laws as we expand.

Please note that we cannot delete information we are legally required to retain, such as insurance transaction records.

The Services are intended for individuals 18 and older. We do not knowingly collect personal information from children under 16, except household information (such as youthful drivers on a policy) provided by a parent or guardian in connection with an insurance application. If you believe a child has provided us information directly, contact us and we will delete it.

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy with a new effective date and, where required, by additional notice such as email or in-app notification.
