PolicyPocket Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and PolicyPocket Insurance Agency LLC, a New Jersey licensed insurance producer (NPN 22289386), and PolicyPocket LLC, a Delaware limited liability company that owns and operates the website, mobile application, and technology platform (together, "PolicyPocket," "we," "us," or "our"). By creating an account, requesting a quote, or otherwise using our website, mobile application, AI assistant, and related services (the "Services"), you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.

PolicyPocket is an independent insurance agency. We help you obtain quotes from multiple insurance carriers, place coverage with the carrier you select, and service your policies.

• We are not an insurer. Insurance policies are issued by third-party insurance carriers, not by PolicyPocket. All coverage is governed exclusively by the terms, conditions, and exclusions of the policy issued by the carrier — not by anything on our website, in our app, or in a chat.
• Quotes are estimates. Quotes are based on the information you provide and information obtained from third-party sources, and are subject to carrier underwriting, verification, and approval. Your final premium may differ from your quote.
• We do not provide legal, tax, or financial advice. Information provided through the Services, including coverage education, is general in nature.

You must be at least 18 years old, reside in a state where PolicyPocket is licensed to transact insurance, and have the legal capacity to enter into contracts. The Services are currently available to New Jersey residents; availability in other states will be reflected in the app as we expand.

• No coverage until confirmed. Requesting a quote, submitting an application, or making a payment does not create insurance coverage. Coverage is bound only when you receive written confirmation of binding from PolicyPocket or the carrier (which may be delivered in the app or by email). Until then, you are not insured through the Services.
• Carrier decisions control. Carriers may decline, modify, re-rate, or condition coverage based on underwriting. If a carrier changes or declines your application after binding, we will notify you and help you find alternatives, but we do not guarantee that any carrier will offer or maintain coverage.
• Your responsibilities after binding. You are responsible for reading your policy documents, paying premiums when due, and notifying us of changes that may affect your coverage (new drivers, vehicles, address changes, and similar).
• Cancellations and changes. Policy changes and cancellations take effect according to the carrier's rules and applicable law, not at the moment you request them in the app.

Our AI assistant ("Andy") helps you through quoting and service, supervised by licensed insurance agents. Andy is an automated system: despite our safeguards, it may occasionally produce incomplete or inaccurate responses. Statements made by the AI assistant do not modify any insurance policy, bind coverage, or waive any carrier or PolicyPocket right. Authoritative information about your coverage is found in your policy documents, and binding of coverage is handled by licensed agents. If anything Andy says appears to conflict with your policy documents or a written confirmation, the documents control — and please tell us so we can fix it.

• PolicyPocket does not charge you any fees. We are paid a commission by the insurance carrier that issues your policy, and if we ever introduce a fee, we will tell you in writing before it applies.
• You can pay premiums by bank account, connected through Plaid, or by payment card, held by our secure payment provider. To process a payment, a licensed agent passes your payment details to your insurance carrier, and the carrier charges the premium. You authorize us to pass your payment details to your carrier for this purpose, and you authorize your carrier to charge the payment method you provide for premiums and other amounts you approve. Payments made in the app are not instant, so make an in-app payment at least one business day before your due date.
• If you enroll in autopay, you authorize recurring charges on your policy's billing schedule until you cancel autopay, which you can do through the app or by contacting us. Cancelling autopay does not cancel your policy or your obligation to pay premiums.
• Returned payments, chargebacks, or failed ACH transfers may result in fees (from the carrier, bank, or processor), policy cancellation for nonpayment, or both. Carriers set their own billing, installment, and late-fee terms, which are disclosed in your policy documents.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@policypocket.ai if you suspect unauthorized access. We may suspend or terminate accounts for security reasons, fraud, abuse, or violation of these Terms.

You agree not to: (a) provide false information or impersonate another person; (b) use the Services to obtain quotes or coverage for someone without their authorization; (c) interfere with, probe, scrape, reverse-engineer, or disrupt the Services or their security; (d) use automated systems to access the Services without our written permission; (e) attempt to manipulate the AI assistant to produce content unrelated to your insurance needs or to extract other users' information; or (f) use the Services for any unlawful purpose.

The Services — including the software, AI models, designs, text, graphics, logos, and trademarks — are owned by PolicyPocket LLC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial insurance needs. Feedback you provide about the Services may be used by us without restriction or compensation.

The Services incorporate third-party services, including Canopy Connect (prior insurance retrieval), Plaid (bank connections), identity verification, and payment processing. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for their acts or omissions. Links to third-party websites are provided for convenience and are not endorsements.

By using the Services, you consent to receive communications from us electronically as described in our electronic communications consent and Privacy Policy. Text-messaging terms (including STOP/HELP) are described in the Privacy Policy.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, POLICYPOCKET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT QUOTES WILL MATCH FINAL PREMIUMS, OR THAT ANY CARRIER WILL OFFER, MAINTAIN, OR RENEW COVERAGE. NOTHING IN THIS SECTION LIMITS OUR DUTIES AS A LICENSED INSURANCE PRODUCER UNDER APPLICABLE LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW: (a) POLICYPOCKET WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES; AND (b) POLICYPOCKET'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $500 OR THE FEES YOU PAID TO POLICYPOCKET (EXCLUDING INSURANCE PREMIUMS REMITTED TO CARRIERS) IN THE 12 MONTHS BEFORE THE CLAIM AROSE. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY ARISING FROM OUR OBLIGATIONS AS A LICENSED INSURANCE PRODUCER, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT. CLAIMS UNDER AN INSURANCE POLICY ARE AGAINST THE ISSUING CARRIER AND ARE GOVERNED BY THE POLICY, NOT THESE TERMS.

Except for small-claims matters and claims that by law cannot be arbitrated, you and PolicyPocket agree to resolve disputes arising out of these Terms or the Services through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Union County, New Jersey or remotely. You and PolicyPocket each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing support@policypocket.ai within 30 days of first accepting these Terms with the subject "Arbitration Opt-Out" and your name and account email. This section does not limit your right to file complaints with the New Jersey Department of Banking and Insurance or any other regulator, and does not apply to disputes with an insurance carrier under a policy.

You agree to indemnify and hold PolicyPocket harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or false or unauthorized information you provide, except to the extent caused by our own wrongdoing.

You may stop using the Services at any time; terminating your account does not by itself cancel any insurance policy, which must be cancelled through the applicable carrier process. We may suspend or terminate your access for violation of these Terms, fraud, or legal or security reasons. Sections that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Dispute Resolution, Indemnification, Governing Law and Miscellaneous) survive termination.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Nothing in these Terms limits any rights you have under New Jersey insurance law that cannot be waived by contract.

We may update these Terms from time to time. Material changes will be posted with a new effective date, and where required we will provide additional notice (such as email or in-app notice). Continued use of the Services after changes take effect constitutes acceptance. Changes do not apply retroactively to disputes that arose before the change.

These Terms, together with the Privacy Policy and any consents you provide in the Services, are the entire agreement between you and PolicyPocket regarding the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Translations of these Terms into Spanish or Portuguese are provided for convenience; the English version controls in the event of a conflict.
